Terms and Conditions

1. Acceptance of Terms

By accessing or using the FTS Outdoors platform (“Platform”), you agree to these Terms and Conditions. If you do not agree, you must not use the Platform.

By creating an account or clicking “I agree,” you consent to electronic contracting and acknowledge that these Terms form a legally binding agreement between you and FTS Outdoors.

2. Eligibility and Authorized Use

The Platform is intended for use by adult leaders and authorized representatives of youth organizations. By creating an account, you represent that you are at least 18 years of age and have the authority to bind your organization to these Terms.

Youth users may access the Platform only under the authorization and supervision of adult leadership.

Users under 18 may not create accounts directly. Youth accounts must be created or invited by an authorized adult leader.

3. Independent Organization

FTS Outdoors is an independent nonprofit organization and is not affiliated with, endorsed by, or operated by Scouting America, the Boy Scouts of America, or any of their councils.

4. Purpose of the Platform

The Platform is provided as a digital tool to assist youth organizations in managing activities such as attendance, inspections, inventory, and leadership development. The Platform is informational and organizational in nature and does not replace the judgment, supervision, or responsibility of adult leaders or governing bodies.

5. Adult Supervision and Responsibility

Each organization and its adult leaders are solely responsible for ensuring appropriate supervision, safety, and compliance with all applicable policies, laws, and best practices. FTS Outdoors does not supervise users, verify activities, or enforce organizational policies.

The Platform does not allow private one-on-one communication between an adult and a youth user. Organizations and leaders must follow Scouting America Safeguarding Youth Training and all applicable youth protection policies when using this Platform with users under 18.

6. Outdoor Activities and Risk

FTS Outdoors supports programs that may involve outdoor and leadership activities with inherent risks. The Platform does not monitor, manage, or control activities, safety procedures, transportation, or supervision. All risk management decisions remain the responsibility of the participating organization and its leadership.

7. Accuracy and Data Responsibility

FTS Outdoors does not guarantee the accuracy, completeness, or reliability of information entered into the Platform. Users and organizations are responsible for verifying records and ensuring data accuracy.

8. Data Ownership and License

Organizations retain ownership of their data. By using the Platform, you grant FTS Outdoors a limited, non-exclusive license to store, process, display, and use data solely to provide, maintain, secure, and improve the service.

9. Content Responsibility

You are solely responsible for all data, files, images, and materials uploaded or entered into the Platform. You represent that you have all necessary rights, permissions, and authority to use and share this content and that it does not violate any law or the rights of others.

The inclusion of content in the Platform does not imply endorsement or review by FTS Outdoors.

10. Intellectual Property

All software, technology, branding, features, and functionality of the Platform are owned by FTS Outdoors or its licensors and are protected by intellectual property laws.

During an active subscription, you are granted a limited, non-exclusive, non-transferable license to access and use the Platform. No ownership rights are transferred. You may not copy, modify, reverse engineer, or attempt to recreate the Platform.

11. Third-Party Services

The Platform may integrate or link to third-party services, including Stripe for payment processing. These services operate under their own terms and privacy policies. FTS Outdoors is not responsible for the actions, availability, or performance of third-party services.

12. Equipment and Inventory

Inventory and equipment tracking features are provided for organizational purposes only. FTS Outdoors is not responsible for lost, stolen, damaged, or mismanaged equipment, nor for disputes between users or organizations.

13. Service Availability and Changes

The Platform is provided on an “as available” and “as is” basis. We do not guarantee uninterrupted service, data availability, or error-free performance.

We may update, modify, or discontinue features at any time to improve the Platform or comply with legal or operational requirements.

14. Security and Acceptable Use

You agree not to misuse the Platform, interfere with its operation, attempt unauthorized access, introduce malicious code, or use the Platform for unlawful or harmful activities.

We reserve the right to suspend or terminate accounts involved in abuse, fraud, excessive disputes, or chargebacks.

15. Subscription, Trial, and Billing

FTS Outdoors includes free modules and paid modules. Roster Board, Attendance, Uniform Inspections, and the Unit Library are free. Messaging, Calendar, Inventory, and newly released paid modules require a subscription.

Paid subscriptions are billed per unit (not account-wide), with monthly and annual options. If you manage multiple units, each unit requires its own subscription.

Pricing is $9.99/month or $99/year. The 30-day trial applies to annual subscriptions only. Monthly plans do not include a trial.

Subscription purchase and management are provided through website billing flows and Stripe-hosted checkout and account management pages.

Subscriptions automatically renew until canceled. If canceled during an active billing period, access remains available through the end of the paid period.

If payment fails or a subscription is not renewed, access may be suspended or locked until billing is restored.

Canceled subscriptions may have associated data permanently deleted 30 days after cancellation.

16. Payment Processing and Authorization

Subscription payments are processed through Stripe. By subscribing, you authorize recurring billing through your selected payment method.

You are responsible for maintaining valid payment information and managing cancellation through Stripe billing management or your account settings.

17. Refund Policy

Except where required by law, subscription fees are non-refundable after a billing period begins. Annual trials may be canceled before billing begins.

Any exception is granted at the sole discretion of FTS Outdoors and does not create an ongoing obligation.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the Platform and all services are provided “as is” and “as available,” without warranties of any kind.

19. Limitation of Liability

To the fullest extent permitted by law, FTS Outdoors and its officers, volunteers, and affiliates shall not be liable for any indirect, incidental, or consequential damages.

Total liability shall not exceed the amount paid in the twelve (12) months preceding the claim.

20. Indemnification

You and your organization agree to indemnify and hold harmless FTS Outdoors from claims, damages, or legal actions arising from your use of the Platform, your content, or your activities.

21. Suspension and Termination

We may suspend or terminate access for non-payment, violations of these Terms, suspected abuse, or legal requirements.

22. Force Majeure

FTS Outdoors is not liable for delays or failures caused by events beyond reasonable control.

23. Modifications to These Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of updates.

24. Governing Law and Disputes

These Terms are governed by the laws of the State of Idaho. Any disputes will be resolved in Idaho courts.

25. Assignment and Entire Agreement

We may assign or transfer these Terms in connection with a merger, acquisition, or sale of assets.

These Terms constitute the entire agreement and supersede prior communications.

26. Severability

If any provision is found unenforceable, the remainder remains in effect.
